국문 초록

디지털 시대를 맞이하여 인터넷 환경 하에서 우리는 음악, 영화 등 타인의 저작물을 권리자에 대한 동의 없이 손쉽게 그리고 아주 저렴하게 이용하여왔다. 디지털 환경은 우리들의 삶에 양질의 변화를 가져왔지만 저작권법 측면에서는 많은 이슈와 문제를 제기하였다. 특히 인터넷 상에서 원저작물이 복제될 때 복제본과 원본은 질적인 측면에서 거의 차이가 없을 뿐만 아니라 거의 무료로 전송되기 때문에 법적 문제가 있음에도 불구하고 누구든지 이를 이용하려는 경향이 강하다. 이러한 환경 하에서 우리나라는 예컨대,‘삼진아웃제’를 도입하여 인터넷에서 불법적인 이용을 하고 있는 이용자의 계정을 정지시킬 수 있는 법규를 마련하기도 하였다. 그러나 이 제도는 기본권 침해라고 하는 위헌 소지의 논쟁이 있기도 하였다. 한편 네티즌이 정보의 이용자뿐만 아니라 생산자로 되는 웹 2.0시대에서 제3자가 저작물을 이용하는 것을 규제하는 것은 매우 어렵기 때문에 예컨대, 유튜브 등과 협력하여 이익의 일부를 권리자에게 환원시키는 등의 방법을 생각해볼 수도있다. 저작물이라는 무형의 가치에 권리를 부여하는 저작권은 사권이므로 개인의 재산권을 보호할 수 있는 법제를 마련하는 것도 중요하지만, 디지털시대에서 인터넷 환경 하에 다수가 폭넓게 이용할 수 있도록 저작물의 활발한 유통을 도모하는 일 역시 중요할 것이다. 따라서 이러한 환경의 변화로 인하여 저작권의 패러다임이 변화하고 있는 오늘날 저작권의 불법적인 침해에 대한 법적 구제장치를 적절하게 마련하는 것도 중요하지만, 저작물의 이용이 결국 이용자의 몫이기 때문에 저작물의 이용이나 유통이 활발하게 이루어질 수 있도록 저작권자와 이용자를 모두 고려한 법규정, 제도 또는 정책을 마련하는 것이 중요할 것으로 판단된다.

영문 초록

Thanks to the development of digital devices and internet environment, we are living in an environment where digitalized information is so easily and cheaply reproduced as well as modified so that it is very difficult to be differentiated from the original from the perspective of quality. The digital environment has changed the paradigm from the previous media which was the paper. Under these circumstances, digitalized information is separated from media which is tangible material, and distributed through the internet, for example digitalized contents such as music, films, games, fictions are quickly circulated on the internet. However, such acts on the internet without any consent of right-holders face with copyright matters owing to violating copyright. The recently revised Korean Copyright Act has introduced “Three-strikes system” so that user's accounts can be suspended in case that users illegally make use of the digitalized contents on the internet. However, three strikes system could be against the Constitution because it can mostly violate the people's fundamental rights which are guaranteed in the Constitutional Law. It is natural to protect the right holders from illegal acts of copyright infringement, but it would not be appropriate to move only in the direction of protecting right holders excessively. As it is ultimately advantageous for rights holders when their contents are actively used and distributed on the internet. Therefore, it is important to provide a space on the internet for the contents to be used legitimately within the scope that does not infringes right holders' profits, and users also may make use of the contents on the internet without any concern on copyright matters.
